Article 1 : Organisation

SAS PARFUMS CARON with capital of €19,326,390, referred as "the organiser", located 22 rue de l'Elysée 75008 Paris, registered under the number RCS PARIS 562 108 977, is organising a free game with no obligation to buy from the 2nd April 2024 to the 21st April 2024 midnight (day included).

We invite you to read these rules carefully, which govern your participation to the competition. By taking part to the competition, you totally accept these rules and the conditions of use of the www.parfumscaron.com website.

 

Article 2: Participants

This free game with no obligation to buy, is opened exclusively to people who have reached the age of majority on the date the game begins.

Persons who do not meet the above conditions are excluded from the game, as are members of the staff of "The organiser ", and any person who has directly or indirectly participated in the design, production or management of the game, as well as their spouse and family members: direct ascendants and descendants or other relatives, whether or not living under their roof.

"The organizer” reserves the right to ask any participants to provide proofs of the above conditions. Any person who does not meet these conditions or refuses to provide proofs will be excluded from the game and, if they win, will not be entitled to their prize.

Only one participation per person is allowed (same name, same address).

"The organizer” reserves the right to carry out any checks to ensure compliance with these rules.

Participation to the game implies full acceptance of these rules.

 

Article 3: How to enter

Participants must go to the following URL address: https://www.parfumscaron.com/en/pages/jeu_concours

Participants must :

- fill in the form, indicating: title, first name, date of birth, email address and country.

The participant must fully and correctly complete the informations form for his/her registration to be validated. The player is informed and accepts that the informations filled in the registration form is proof of his/her identity. Any participation made contrary to the provisions of these rules will render the participation invalid. Any participant suspected of fraud may be excluded from the competition by the "organiser" without having to justify this. Any identification or participation that is incomplete, erroneous or illegible, whether intentionally or not, or made in a form other than that provided for in these rules, will be considered invalid. The same penalty will be applied in the event of multiple participations.

 

Article 4: Prizes

The prizes are distributed as follows:

- 1st prize: 1 Pour Un Homme classique 750ml (sale price: 375€)

- 2nd to 5th prize: 4 winners of a set of the Pour Un Homme de CARON Trilogy (sale price Pour Un Homme Matin 125ml: 118€, Pour Un Homme Soir 75ml: 97€ and Pour Un Homme de CARON 75ml: 87€, i.e. a total value for a set of: 302€)

- 6th to 10th prizes: 5 winners of Pour un Homme Parfum 75ml (sale price: 120€)

Details:

All costs incurred after the game, in particular for the maintenance and use of these prizes, are entirely at the winner's expense.

 

Article 5: Designation of winners

At the end of the competition, the draw will take place on the 25th April 2024.

Condition(s) for taking part in the prize draw:

People who filled in the form correctly will take part in the prize draw.

 

Article 6: Announcement of the winners

The winners will be notified by e-mail to the address given when they registered for the competition.

 

Article 7: Delivery of prizes

The prizes will be sent to the postal address provided by the participants.

If the prize is returned undelivered, it will remain at the participant's disposal for 15 days. After this period, it will be no longer available.

The winners undertake to accept the prizes as offered, without any possibility of exchange, in particular for cash, other goods or services of any kind, or transfer the benefit to a third party. Similarly, these prizes may not be the subject of requests for compensation.

"The organizer” reserves the right, in case of an event beyond its responsibility, notably linked to its suppliers or to exceptional circumstances, to replace the prizes announced with prizes of equivalent value. The winner will be informed of any changes.

 

Article 8: Use of participants' personal data

Participants informations are recorded and used by "The organiser" to record their participation to the competition and enable them to win the prizes.

Participants can, for legitimate reasons, object to communicate their personal data in the context of this competition. They also have the right to object to their data being used for commercial canvassing purposes, outside of participation to this competition, which they can exercise as soon as their participation is registered by writing to "The organiser" at the address given in article 1.

The winner(s) authorise "The organiser" to use their contact details (surname, first name) for advertising or public relations purposes, in any channel, without conferring any remuneration, right or advantage, other than the award of their prize.

In accordance with the French Data Protection Act (Loi Informatique et Libertés) in its latest version, and with Regulation no. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (RGPD), participants can exercise their right of access, rectification, deletion of data, limitation of processing, related to data portability, to object and  withdraw their consent by writing to "The organiser" at the address given in article 1.

They may be sent free of charge to any person who requests them from "The organiser".

"The organiser reserves the right to extend, shorten, modify or cancel the competition at any time, particularly in the event of an exceptional situation, without the right for the participants to claim any compensation.

The rules, as amended by amendment(s), will be filed, where applicable, with SELARL ACTA - PIERSON et ASSOCIES, a bailiff's office with its registered office at 15 rue de Sarre BP 15126 57074 METZ Cedex 3.

 

Article 10: Industrial and intellectual property

The reproduction, representation or use of all or part of the elements of the game, including these rules, are strictly prohibited.

All trademarks, logos, texts, images, videos and other distinctive signs reproduced on the site and on sites to which it provides access via hypertext links are the exclusive property of their owners and are protected as such by the provisions of the French Intellectual Property Code throughout the world. Their unauthorized reproduction constitutes an infringement punishable by law.

Any total or partial unauthorized reproduction of these trademarks, logos and signs constitutes an infringement punishable by criminal penalties.

Participation in this game implies full acceptance of these rules by the participants.

 

Article 11: Liability

“The organizer” shall not be held liable in the event of force majeure or unforeseen circumstances beyond its control. "The organizer” cannot be held responsible for delays, loss, theft, damage to mail or illegible postmarks caused by the postal services. Neither can it be held responsible and no recourse may be taken against it in the event of the occurrence of events presenting the characteristics of force majeure (strikes, bad weather, etc.) partially or totally depriving participants of the possibility of taking part in the game and/or the winners of the benefit of their winnings.

“The organiser" and its service providers and partners may under no circumstances be held responsible for any incidents that may occur in the use of the prizes by the beneficiaries or their guests once the winners have taken possession of them.

Likewise, "The organiser", as well as its service providers and partners, may not be held responsible for the loss or theft of the prizes by the beneficiaries once the winners have taken possession of them. Any additional cost required to take possession of the prizes shall be borne entirely by the winners, who may not claim any compensation from "The organiser", nor from the service providers or partners.

This competition is not managed or sponsored by Facebook and Instagram, which "The organiser" releases from all liability.

 

Article 12: Disputes and claims

These rules are governed by French law.

“The organiser" reserves the right to settle, without appeal, any difficulty that may arise regarding the interpretation or application of these rules, it being understood that no dispute will be accepted, particularly regarding the terms and conditions of the game, the results, the winnings or their receipt, one month after the end of the game. Except in the case of obvious errors, it is agreed that the information resulting from the “The organiser" game systems has evidential value in any dispute as to the connection elements and the computer processing of said information relating to the game.

Any claim must be sent to "“The organiser" within one month of the end date of the game. After this date, no claim will be accepted. Participation in the game implies full acceptance of these rules.

 

Article 13: Agreement of proof

By express agreement between the participant and “The organiser" , only the computer systems and files of “The organiser" " will be considered as proof.

The electronic registers, kept in the computer systems of "The organiser", in reasonable conditions of security and reliability, are considered as proof of the relations and communications between "The organiser" and the participant.

It is therefore agreed that, in the absence of manifest error, "The organiser" may rely, in particular for the purpose of proof of any act, fact or omission, on programs, data, files, recordings, operations and other elements (such as monitoring reports or other statements) of a computer or electronic nature or format or medium, established, received or stored directly or indirectly by "The organiser", in particular in its computer systems.

The elements considered thus constitute proof and if they are produced as means of proof by "“The organiser" in any litigation or other proceedings, they will be admissible, valid and opposable between the parties in the same way, under the same conditions and with the same probative force as any document that would be drawn up, received or kept in writing.

Operations of any kind carried out using the identifier and code allocated to a participant following registration are irrevocably presumed to have been carried out under the participant's responsibility.
